By accessing or using SafeCircle ("SafeCircle," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must not use the Service. These Terms constitute a legally binding agreement between you and SafeCircle.
To register an Account you must be at least 18 years old and capable of forming a binding contract. Accounts for Child Users (under 16) must be created and managed by a Guardian. You agree to provide accurate, current, and complete information and to keep it updated.
SafeCircle is a child digital-safety platform that enables Guardians to protect Child Users from harmful online content and unsafe communications. The Service includes on-device AI content moderation, communication safety monitoring, and parental controls accessible via the companion app.
The Service uses AI models that run entirely on the Child User's Device to detect potentially harmful content, including but not limited to: violent, adult, or abusive material. No message content or media is transmitted to SafeCircle servers for AI analysis. SafeCircle makes no warranty that the AI will detect all harmful content; it is one layer of protection and not a substitute for Guardian supervision.
The Service may monitor metadata and patterns associated with communications on the Device to identify potentially unsafe interactions (e.g., contact with unknown adults). This analysis is performed on-device. Guardians may receive alerts when patterns consistent with risk are identified.
Guardians are responsible for: (a) configuring the Service appropriately for their Child User; (b) having an ongoing conversation with the Child User about digital safety; (c) ensuring the Device remains under appropriate supervision. SafeCircle is a tool to assist — ultimate responsibility for a child's online safety remains with the Guardian.
The Service is designed for Child Users under 16. A Guardian must create and manage the Account. Child Users may not register independently. We process only the minimum personal data necessary to provide the Service, consistent with the UK Information Commissioner's Office (ICO) Age Appropriate Design Code and GDPR Article 8.
Where the Service processes personal data of a Child User, the lawful basis is the consent of the Guardian (GDPR Art. 6(1)(a) and Art. 8). By creating an Account for a Child User, the Guardian confirms they hold parental responsibility and consent to the processing described in our Privacy Policy. Guardians may withdraw consent at any time by deleting the Child User's profile.
If the Service detects content that indicates a Child User is in immediate danger or at serious risk of harm, SafeCircle may, at its discretion, take steps including alerting the Guardian and cooperating with law enforcement. SafeCircle is not a safeguarding authority and use of the Service does not replace statutory safeguarding procedures.
Our collection and use of personal data is described in detail in our Privacy Policy, which is incorporated into these Terms by reference. By accepting these Terms you also accept the Privacy Policy.
The SafeCircle AI models operate entirely on the Device. Message content, images, and media analysed by those models are not uploaded to or stored on SafeCircle servers. Only metadata required for the Service to function (e.g., alert notifications, account data) is transmitted.
If you are located in the EEA or UK, you have the following rights regarding your personal data: right of access (Art. 15), right to rectification (Art. 16), right to erasure (Art. 17), right to restriction of processing (Art. 18), right to data portability (Art. 20), right to object (Art. 21), and rights related to automated decision-making (Art. 22). We retain personal data only as long as necessary to provide the Service or comply with legal obligations. Account data is deleted within 30 days of account closure. Server logs are retained for 90 days. See the Privacy Policy for full retention periods.
You may use the Service solely for lawful personal, non-commercial purposes in accordance with these Terms. You must be the Guardian or authorised user of any Device on which the Service is installed.

The Service, including its software, AI models, and content, is owned by SafeCircle or its licensors and is protected by intellectual property laws. Public components are open source — see github.com/safecircleia for licensing details. Nothing in these Terms grants you ownership of any SafeCircle intellectual property.
The Service is currently provided free of charge. SafeCircle reserves the right to introduce paid plans in the future with reasonable advance notice.
This section describes terms that will apply when paid subscription plans are introduced. Paid plans are not currently available. When paid plans launch, subscriptions will auto-renew unless cancelled before the renewal date. Prices will be displayed at the point of purchase inclusive of applicable VAT. SafeCircle will provide at least 30 days' notice of any price changes.
If you are a consumer in the EU or UK, you have a statutory right to cancel a paid subscription within 14 days of purchase (cooling-off period) under the Consumer Rights Directive (2011/83/EU) and the Consumer Contracts Regulations 2013. To cancel, contact contact@safecircle.tech. These rights apply when paid plans become available.
The Service is provided "as is" and "as available." To the fullest extent permitted by law, SafeCircle disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. SafeCircle does not warrant that the Service will be uninterrupted, error-free, or that all harmful content will be detected.
To the fullest extent permitted by applicable law, SafeCircle's aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amounts paid by you to SafeCircle in the 12 months preceding the claim or (b) £50. SafeCircle is not liable for indirect, incidental, special, or consequential damages. Nothing in these Terms limits liability for death, personal injury, or fraud.
You agree to indemnify and hold harmless SafeCircle and its officers, directors, and employees from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any third-party rights.
You may terminate your Account at any time by deleting it in the app. SafeCircle may suspend or terminate your access immediately if you breach these Terms, without liability. Upon termination, your data will be deleted in accordance with the retention periods in the Privacy Policy.
These Terms are governed by the laws of England and Wales (placeholder — update when legal entity is registered). Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws of your country of residence provide otherwise.
We aim to resolve disputes amicably. Please contact us at contact@safecircle.tech before initiating legal proceedings. If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
We may update these Terms from time to time. Material changes will be notified via email or a prominent notice in the app at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
